If you do not accept any part of these terms and conditions, please do not use this website.

The website www.BeachShop.co.uk (referred to as ‘the Website’) is operated and owned by Private Equity Systems Limited (trading as BeachShop), a registered company in England and Wales. Our company registration number is 07193494.

The term ‘BeachShop’, ‘we’, ‘us’ or ‘our’ refers to Private Equity Systems Limited. The term ‘you’ refers to the user or viewer of our website.

Unless otherwise stated, all copyrights, trademarks and other intellectual property rights in all content published on the Website, including but not limited to text, graphics, images, sound, videos, animations and codes are owned by us or our licensors. You are strictly prohibited from reproducing, modifying, distributing, publishing any of the content on the Website or implying any connection with you without our written consent.

Permission is granted for downloading or printing materials from the Website for your own personal and non-commercial use only. All rights are reserved by us and our licensors. Unauthorised use of the Website may give rise to a claim for damages and/or be a criminal offence (we can’t think when it would but our legal eagles said put that in J naughty naughty).

ELIGIBILITY TO PURCHASE

You must be aged 18 years or over and can lawfully enter into contracts to purchase goods from the Website. When placing an order with us, you warrant that the information provided is correct and you are the authorised user of the payment method used to complete the order.

ORDER AND PAYMENT

In order to make a purchase from us, you are required to accept our terms and conditions via our online checkout process. Before completing your order, you will be given the opportunity to check and correct your input details. It is your responsibility to inform us immediately if you have made an error in your order.

After you submit your order to us, we will send out a confirmation email to you acknowledging your order details. Please note that this confirmation email does not indicate our acceptance of your order. We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for your payment, that the goods ordered are not available, that there are shipping restrictions to certain destinations, or that you do not meet the eligibility criteria set out in our terms and conditions. In addition, we may reserve the right to refuse to accept your order, for any reason, at our sole discretion.

Your order is deemed to be accepted by us when we dispatch your goods. You will receive an email confirming your goods have been dispatched. This is when a purchase contract between you and us forms.

All orders are shipped from our warehouse in the UK. Occasionally, we may be waiting for shipments from our suppliers. Any delays of the goods will be notified to you by email or telephone. If an item is out of stock, or cannot be supplied for any reason, we will contact you within five business days of the order being placed (we will try and let you know as soon as possible of course). In cases where we cannot fulfil your order, we will refund your card and your order will be cancelled. From time to time, you may also be given the possibility of making an advance purchase of an item that is out of stock. This gives you priority over customers in the waiting list to receive the goods once the stock has been replenished. Your rights for the advance purchase remain the same as those for the usual purchase on the Website. If, however, for any reason, we cannot deliver these goods, we will contact you by email and refund the advance payment to you within 30 days from the date we inform you of the goods being unavailable.

All transactions on our website are currently processed by PayPal, one of the most secure and trusted payment processing solutions in the world. When placing an order with us, you will be asked to enter your payment details including your name, billing address, card information and etc. All such information is encrypted using SSL (Secure Socket Layer) technology via a secure gateway between us and PayPal, and is only used to process your order. We do not store your payment card details nor do we share them with any third parties.

We take extra steps to provide you with an additional secure payment option. In case you do not wish to use your credit cards or debit cards online at all, we also accept payments via PayPal. For further details on payment security, please see Safe Online Shopping section of the Website.

CONTRACT

A purchase contract forms between you and us when we dispatch your goods. You will receive an email from us notifying you that we have dispatched your order.

PRODUCTS AND PRICING

All listed prices shown on our products include UK VAT at 20%. The pricing, however, does not include any delivery or customs charges.

Where appropriate, we will exclude VAT from your order at checkout depending on your shipping destination.

Please note that any import duty, local taxes and other fees arising from importing our goods into your country must be paid by you.

We reserve the right to make changes to the products and pricing listed on the Website, and any other Website content, at any time without warning.

DELIVERY

We offer UK domestic and international shipping. All products are dispatched from our UK warehouse. We aim to deliver your order as soon as it has been processed. Please allow up to 2 business days for orders to be processed.

Dependant on the postage option selected, our deliveries may be insured during the shipping period until they reach you. Upon dispatch, we will send you a confirmation email which if shipped by courier the tracking information and the courier details.

For deliveries to UK addresses, we use Royal Mail Next Day Special Delivery. For deliveries to overseas destinations, we use either Royal Mail Airsure or FedEx. Please see our website for postage charges. We reserve the right to change shipping charges at any time without notice.

Orders shipped outside the UK and European Union may incur import duties or other taxes and fees applied by local customs authorities. Please note that any customs charges, local taxes or administration fees paid to couriers as a result of importing goods into your country, should be paid directly by you. We cannot take any responsibilities for the payment of these charges.

Please note that we have no control over third parties’ delivery services. Therefore, we cannot be held liable for any delays of your shipment.

PROMOTION

All promotion codes or coupons on the Website have a limited offer time and must be redeemed by the date specified. They cannot be used in conjunction with other promotion codes or offers. In addition, they cannot be exchanged for cash.

CANCELLATION AND RETURNS / EXCHANGE

Under the United Kingdom's Distance Selling Regulations you have the right to cancel your order for any item purchased from BeachShop, for a full refund.

Order cancellations must be made in writing, quoting your order number, within 7 working days of the day after you receive the goods to “returns@BeachShop.co.uk”.

If however your order has already been processed, you will need to return the order to us.

RETURN or Exchange an Item

If you are not completely satisfied with your purchase, simply return the item or items to us in their original condition* within 14 days of receipt.

Important: Swimwear returns will not be accepted if the hygienic protection label has been removed.

If you return items to us after the expiry of the 7 days once receiving the RMA and/or in an unacceptable condition, we may not refund your account. An administration charge of £4.95 for smaller items, and £12.95 for larger items will be made. We may, at our discretion, return your items to you (at a cost to you of the actual postage rate). If you send the items back to us again, or refuse to accept delivery, this will be deemed as irreversible authority for us to dispose of your goods without further notice. Disposal will not constitute any admission on our part that we have failed in any way to honour our obligations to you in full and will not constitute any unlawful action against the goods. Acceptance of a return by your courier is not deemed to be acceptance by the company. This does not affect your statutory rights.
